On Oct. 20, 2013, Mario Garcia-Sura was operating his 2001 black Ford Mustang convertible along Riverdale Avenue in Yonkers, and he had a front-seat passenger with him, according to a release from the District Attorney's Office.
The two men had met earlier in the day in a local deli and during the course of the afternoon began to drink together and drove around in the defendant’s Mustang visiting neighborhood bodegas drinking beers, according to the release.
About 5:13 p.m., Garcia-Sura drove his Mustang down Riverdale Avenue at a high rate of speed, according to the release, and at the intersection of Riverdale Avenue and Franklin Avenue collided with a 2004 gold Hyundai Sonata operated by Chandran.
The victim was taken to St. Joseph’s Medical Center Hospital where he was pronounced dead.
Garcia-Sura’s passenger was taken to Jacobi Medical Center where he was admitted for severe injuries to his lower body.
Garcia-Sura was charged with one count of aggravated vehicular homicide, two counts of second-degree vehicular manslaughter, one count of criminally negligent homicide, two counts of driving while intoxicated, one count of reckless driving and two counts of speeding, according to the release.
Garcia-Sura faces a maximum of 25 years in state prison.
Bail was set at $250,000 cash or bond. He is set to appear in court again on Feb. 25.
