Acting Westchester County District Attorney James A. McCarty announced that Franklin Figueroa, 34, of Jefferson Valley, has been indicted and charged with three counts of unlawful surveillance and two counts of endangering the welfare of a child.
The defendant was on the platform stairwell after getting off a shuttle bus from John F. Kennedy Catholic High School just before 3 p.m.
The suspect, sitting in that same stairwell, used a concealed video camera and recorded images from underneath the victim's and other female students' skirts.
The victim, realizing what was happening, quickly photographed the defendant and his camera with her cellphone and wrote down the license plate number of the vehicle where he retreated.
The MTA Police were immediately contacted and the defendant was later arrested.
Several recording devices were seized from the defendant and searched pursuant to a search warrant. The devices revealed an earlier offense involving a student at the Goldens Bridge train station from the spring of 2014.
At the time of the incident, the defendant was working for Laz Parking in Collections and Enforcement, which is contracted to conduct parking enforcement at the train station.
Figueroa continues to be employed by them.
He was released n his own recognizance pending a May 10 court date.
The defendant faces a maximum sentence of four years in state prison.
Assistant District Attorney Michelle Lopez of the Sex Crimes Bureau is prosecuting the case.
